Rental terms and conditions

Article 1 – Scope of the General Terms and Conditions

The present General Terms and Conditions of Rental (GTC) apply to and form an integral part of any contract relating to tourist stays concluded between Domaine Legros – Chalets Nord & Sud, operated by SRL Horticulture Legros, whose registered office is located at Rue Hodiamont 52, 4802 Heusy – Belgium, registered with the Crossroads Bank for Enterprises under number 0755.581.302 (hereinafter “Domaine Legros”), and its clients (hereinafter the “Guest” or “Guests”).

The seasonal rental contract is deemed concluded upon validation of the reservation and full payment of the stay. Electronic acceptance constitutes an electronic contractual signature in accordance with Belgian law.

These GTC govern any reservation and any stay at Domaine Legros concerning the Nord and Sud chalets. Any reservation implies full, complete, irrevocable and unconditional legal acceptance of these GTC.

Article 2 – Reservation Conditions

2.1 Price and Payment

The price of the stay is indicated in euros, including VAT and tourist taxes.

Full payment of the stay is required before entering the premises. No keys will be handed over without full payment.

In case of late payment of the balance, the reservation may be cancelled without prior notice and without prejudice to Domaine Legros’ right to claim full payment of the reservation.

2.2 Withdrawal

The legal provisions relating to the right of withdrawal for distance sales provided by the Belgian Code of Economic Law do not apply to tourist services. Therefore, for any reservation made with Domaine Legros, the Guest does not benefit from the right of withdrawal provided for in Article VI.47 of the Code of Economic Law (Art. VI.53, 12° of the Code of Economic Law).

2.3 Cancellation and Modification of Reservation

a) Any confirmed reservation is firm and final. No refund, full or partial, will be granted in case of cancellation, no‑show, or early departure by the Guest, regardless of the reason. Any partial or full refund that may be exceptionally granted, solely upon the express, written and prior decision of the owner, shall not constitute a right or precedent for future reservations.

b) Guests are advised to take out or verify whether they benefit from cancellation insurance that may reimburse the amounts paid in case of cancellation or early departure under certain conditions (illness, accident, etc.).

c) Reservations are nominative, and the Guest is prohibited from transferring their reservation to a third party, for any reason, without the prior written consent of Domaine Legros.

2.4 Cancellation of the Stay by Domaine Legros

Domaine Legros reserves the right to cancel the stay preventively, including after it has begun, if one of the following conditions occurs:

Weather conditions endangering the safety of Guests during their stay.
Failure of the wastewater treatment system requiring temporary closure of the chalet for repairs.

In such cases, Domaine Legros commits to seeking an alternative solution in consultation with the Guest. If no alternative solution is suitable for the Guest, or upon the Guest’s request, a full refund of the stay (minus any services or nights already consumed) will be considered a fair solution and accepted by both parties without the possibility of further claims.

Article 3 – Course of the Stay

3.1 Check‑in and Check‑out

Check‑in is from 2:00 p.m. for the Nord chalet and 3:00 p.m. for the Sud chalet.

Check‑out must occur before 11:00 a.m. for the Nord chalet and before 12:00 p.m. for the Sud chalet.

3.2 Late Return of Keys

Any return of keys after the time indicated in Article 3.1 will result in the billing of an additional night. Any request to extend the stay must be made at least 24 hours before the scheduled departure date.

3.3 House Rules

To ensure a pleasant stay for all Guests, they must comply with the rules set out in the House Rules, available on the website. Any violation may result in expulsion from the domain without refund, in whole or in part, and/or compensation as provided in the House Rules.

Guests are responsible for ensuring that any person they allow into the domain complies with the House Rules.

3.4 Number of Guests

The number of Guests must never exceed the accommodation capacity indicated in the reservation.

The number of persons is strictly limited to that declared at the time of booking.

Any undeclared additional person or exceeding of capacity may result in immediate termination without refund and possible legal action for damages.

Article 4 – Liability

No security deposit is required.

In return, the Guest listed as the contact person for the reservation is responsible for the actions and any damage, loss or deterioration caused to the equipment, furniture, indoor/outdoor installations and common areas, both by themselves and by any other Guests included in the reservation. Any damage discovered after departure may be billed afterwards based on photos, reports, quotes or invoices.

The Guest acknowledges that the accommodations (Nord & Sud chalets) are high‑standard properties. They accept an enhanced duty of care. Any damage will be assessed based on replacement value, including indirect costs such as immobilization of the accommodation and labor.

Except in cases of gross negligence or intentional fault by Domaine Legros, the latter is not liable for:

theft, loss, damage or accident of any kind during or after the stay,

malfunction or breakdown of equipment during the stay.
Domaine Legros also declines all liability in case of accidents in the chalets or, more generally, on the entire property.

The Guest declares that they are covered by private civil liability insurance.

The Guest and accompanying persons must occupy the premises as normally prudent and diligent individuals.

If the Guest or anyone accompanying them causes damage, they must immediately report it to Domaine Legros. Domaine Legros reserves the right to invoice the value of the damaged item and/or the cost of repairs. Domaine Legros may also terminate the contract without notice in case of serious breach of the GTC, without refund and without prejudice to any claim for damages.

At the beginning of the stay, the Guest must check the condition of the accommodation and its equipment upon receiving the keys. If no defect is reported (by call or SMS) at the start of the stay, the accommodation and its equipment will be considered to have been provided in perfect condition.

Final cleaning is included in the reservation price. However, if the accommodation has not been used with normal care and is left in an abnormally dirty condition requiring exceptional cleaning (e.g., irreversibly stained linens), additional cleaning fees may be charged.

Use of the wellness facilities (sauna/jacuzzi) is under the responsibility and supervision of the Guest responsible for the reservation. These facilities are unsupervised and prohibited to minors without adult supervision. Domaine Legros declines all liability in case of accidents.

Parties, events, receptions, filming or non‑touristic uses are strictly prohibited. Any violation will result in immediate expulsion without refund and without prejudice to any claim for damages. The same applies in case of nuisance to the neighborhood requiring intervention by the owner or authorities.

Animals are prohibited unless prior written authorization is granted. Any violation may result in immediate cancellation of the rental and full billing of damages.

Article 5 – Force Majeure

Domaine Legros is not liable for loss or damage resulting from delays or failure to perform any contractual obligation when such delay or failure results from a case of force majeure. Force majeure includes any unforeseeable event beyond the control of Domaine Legros, such as natural disasters, epidemics, fire, accident, war, insurrection, riot, terrorism, strikes, lock‑outs, market disruptions, telecommunications or electricity failures, government actions or court orders.

Article 6 – Complaints

Complaints during the stay must be reported on site as soon as possible so that a solution can be found. If a complaint cannot be resolved satisfactorily or if the Guest is unable to report it during the stay, they must submit their complaint within 14 days after the end of the stay, by email to horticulturelegros@gmail.com or by postal mail to Rue Hodiamont 52, 4802 Heusy.

Article 7 – Personal Data & Privacy

Domaine Legros processes your data exclusively within the framework of the contractual relationship and in compliance with the General Data Protection Regulation (GDPR).

Article 8 – Applicable Law & Jurisdiction

These GTC are governed by Belgian law, and any dispute relating to their application falls under the exclusive jurisdiction of the courts of the judicial district of Verviers.
